Welcome to Bright in the Middle. These Terms & Conditions apply to www.brightinthemiddle.com, including our blog, shop, digital resources, and other website content.
Please review these terms before using the website or purchasing or downloading a resource. By using the website or obtaining a resource, you agree to the applicable terms below.

Website Content and Copyright
Unless otherwise noted, website content, including blog posts, photographs, graphics, videos, logos, and digital resources, is owned by or licensed to Bright in the Middle.
You are welcome to read our blog posts, use the ideas in your own teaching, and share links to our website.
You may reference our content in blog posts, presentations, seminars, or professional development sessions with credit to Bright in the Middle and a link to the original content. This permission does not include distributing resource files or republishing complete posts, images, or other materials.
Except for the uses permitted in these terms or allowed by applicable law, you may not copy, republish, distribute, sell, or otherwise reproduce our content without written permission.
Digital Products and Delivery
All products sold through the Bright in the Middle shop are digital resources. No physical products will be shipped.
After payment is completed, you will receive an email with a download link. Your purchased files will also be available in your shop account.
Please read the product description before purchasing to confirm the included materials, file types, and software or accounts needed. Some resources may require Adobe Acrobat Reader, Microsoft PowerPoint, Google Slides, Google Classroom, or other programs.
Please save a copy of downloaded files for your own teaching and backup purposes.
If you cannot find your download email, check your spam folder and shop account. For assistance, email kayla@brightinthemiddle.com or use our contact form.
Resource License and Terms of Use
Thank you for choosing a Bright in the Middle resource!
Purchasing or downloading a resource gives you a license to use it. It does not transfer copyright or ownership of the content.
Unless a product description or separate agreement states otherwise, each purchased or free resource is licensed for one user. One user means one educator using the resource with the students they personally teach, including multiple classes, homeschool instruction, or tutoring sessions.
You may:
- Print and make copies for the students you teach.
- Display resources to your own students during instruction.
- Use individually purchased resources with your own students year after year.
- Save copies on your own devices or private storage for your teaching and backup purposes.
- Make your own copy of a Google resource using the provided copy link and assign copies to your students through Google Classroom or a similar restricted-access learning platform.
- Modify portions of resources provided as editable for your own teaching use.
- Direct other educators to our website to obtain their own copies.
You may not:
- Share original or edited resource files with other educators for their independent use.
- Place resources in a shared school, department, or district folder for other educators to use unless your license expressly permits it.
- Post resources or their copy links publicly or make them available as public downloads.
- Resell, redistribute, repackage, or give away resources, in whole or in part, except for the student copies permitted above.
- Use any part of a resource to create another product for sale or distribution.
- Extract clipart, photographs, graphics, or other included elements for separate use unless expressly permitted.
- Claim a resource as your own or remove copyright information, credits, or watermarks.
Edited versions remain subject to the same license and sharing restrictions. Permission to edit applies only to portions provided as editable.
Copies provided to students are for instructional use only. Permission to provide student copies does not authorize further sharing, posting, or redistribution.
A standard single-user purchase does not provide a license for an entire department, school, or district. Please contact us to discuss use by multiple educators.
Membership and Other Licenses
Membership resources and school or multi-user purchases may have additional or different terms. Please review the applicable agreement and the membership section below.
Nothing in these terms limits rights that cannot be restricted under applicable law.
Refunds and Exchanges
Because our products are digital files, once a resource has been downloaded, we do not offer refunds or exchanges, except where required by applicable law.
If you have not downloaded your purchase, contact us to request a refund or exchange. Requests will be reviewed individually.
If you have difficulty accessing a file or believe there is a problem with your purchase, please contact us so we can help.
This policy applies to individual shop purchases. Membership refunds are addressed in the separate membership terms.
Nothing in this policy limits rights or remedies you may have under applicable law.
Bright in the Middle Membership
The Bright in the Middle Membership has separate terms covering membership billing, cancellation, refunds, access, and license duration.
Please review the Bright in the Middle Membership Terms & Conditions, along with the offer presented when you sign up.
Membership-specific billing, cancellation, refunds, access, and license duration are governed by the membership terms and the offer accepted at signup.
For membership questions, email kayla@brightinthemiddle.com or visit our contact page.
Accounts and Passwords
Please provide accurate account and purchase information and keep your login details secure.
Do not share your account or password with others. Contact us promptly if you believe someone has accessed your account without permission.
Email Communication
We may send emails needed to deliver your purchase or provide information about your order, account, or membership.
We may also send promotional emails about resources, offers, and updates. You can unsubscribe from promotional emails using the unsubscribe link in those messages. Unsubscribing from marketing does not prevent necessary order, account, or membership communications.
Product Information and Website Availability
We work to keep product descriptions, prices, and website information accurate. We may correct errors and update information, prices, and future product availability.
If an error affects an order you have placed, we will contact you to explain the issue and available options.
We cannot guarantee uninterrupted website access. If a technical issue prevents you from accessing a purchase, please contact us for assistance.
Comments and Submissions
You are responsible for comments and other content you submit to the website. Only submit content you own or have permission to share.
Do not submit content that is unlawful, abusive, infringes another person’s rights, or includes private information you do not have permission to disclose.
By submitting a comment for public posting, you give us permission to display that comment and the name you provide on the website. You retain ownership of your original content.
We may remove spam, unlawful content, or comments that violate these terms. Nothing in these terms prohibits honest reviews or lawful criticism.
Links to Other Websites
Our website and resources may include links to third-party websites, tools, or services. We do not control their content, availability, policies, or practices.
Please review the applicable terms and privacy policies when using third-party services.
Acceptable Use
You may not use the website to violate applicable law, infringe another person’s rights, interfere with website operations, upload malicious software, or attempt to gain unauthorized access to accounts or systems.
Except where permitted by applicable law, you may not use automated tools to copy, collect, or redistribute website content without permission.
Educational Use and Disclaimer
Our content and resources are provided for educational purposes. Educators are responsible for deciding whether an activity or resource is appropriate for their students and following applicable school policies, supervision requirements, and safety procedures.
We work to provide accurate and helpful materials, but we do not guarantee particular learning outcomes or that every resource will meet every classroom’s needs.
To the extent permitted by applicable law, the website and its content are provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or noninfringement.
Limitation of Liability
To the extent permitted by applicable law, Bright in the Middle will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or resources.
Nothing in these terms excludes or limits liability, warranties, or remedies that cannot lawfully be excluded or limited.
Privacy
Please review our Privacy Policy for information about how personal information is collected and used.
Changes to These Terms
We may update these terms from time to time. The effective date appears at the bottom of this page.
Changes will be handled in accordance with applicable law and the terms governing existing purchases or memberships. Updating this page does not, by itself, replace the terms applicable to an earlier purchase.
Severability
If a provision of these terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Accessibility
We want everyone to be able to use this site. We use generally recognized accessibility guidelines, such as the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, as a guide, and we review the site from time to time as it changes. Some content, including features provided by third parties and some downloadable resource files, may not be fully accessible.
